Terms & Conditions

These Terms & Conditions apply when you request a quotation, approve artwork, place an order, use our services or otherwise enter into a transaction with Dynamic Signs & Print.

Please read these Terms & Conditions before approving a quotation or placing an order. Project-specific information contained in an accepted quotation, approved artwork or other written agreement with DSP forms part of the terms applying to that particular job.

Introduction and acceptance

Dynamic Signs & Print ("DSP", "we", "us" or "our") provides printing, signage, branding, design and related production services.

By accepting a quotation, giving written approval to proceed, approving artwork, making the required payment or otherwise placing an order with DSP, you agree to the Terms & Conditions applicable to that transaction.

Nothing in these Terms & Conditions is intended to exclude, restrict or waive any right or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") or any other applicable South African law.

Quotations

  • Quotations are valid for 14 days from the date of issue unless a different validity period is stated on the quotation.
  • A quotation is based on the specifications, quantities, artwork, dimensions and other information available to DSP at the time it is prepared.
  • Prices may be revised where the customer changes the specification, quantity, artwork, dimensions, finishing or other requirements after quotation.
  • If information supplied for quotation purposes proves to be incomplete or materially different from the final requirement, DSP may issue an amended quotation before proceeding.

Orders and confirmation

Unless otherwise agreed in writing, an order is regarded as confirmed once DSP has received the required payment and written customer approval to proceed.

Written approval may include approval provided by email, WhatsApp or another recordable electronic communication accepted by DSP.

The customer is responsible for ensuring that all instructions, quantities, sizes, wording, spelling, contact details and other job information supplied to DSP are correct.

Payment

Payment is required in advance unless different payment terms have been agreed by DSP in writing.

DSP is not required to commence or continue production until any payment required before production has been received.

Where agreed payment terms are not met, DSP may pause production, collection or delivery until the outstanding payment position has been resolved, subject to applicable law and any written agreement with the customer.

Artwork, proofs and customer approval

Where appropriate, DSP may provide artwork or a proof for customer review before production.

Before approving artwork, the customer should carefully check:

  • spelling, grammar and wording;
  • names, telephone numbers and contact information;
  • logos and supplied brand elements;
  • quantities and dimensions;
  • layout and content placement; and
  • the overall approved design requirement.

Once artwork has been approved, the approved file will generally be treated as the production reference for the job. Corrections or changes requested after approval may require additional artwork or production work and may therefore incur additional charges.

Important artwork approval notice

Customer approval does not remove DSP's responsibility for an error that DSP itself introduces during production, nor does it limit any non-waivable right the customer may have under applicable law. Approval confirms the customer's acceptance of the information and artwork presented for approval.

Colour, size and production variations

Printing and physical production involve different materials, processes, machines and finishing methods. Screen displays also reproduce colour differently from printed output.

Reasonable minor variations in colour, finish or physical production may therefore occur where these are inherent in the relevant production process and do not amount to a defect or a material failure to meet the agreed specification.

Where colour matching or another production characteristic is particularly important, the customer should raise this with DSP before approving the job so that the requirement can be considered during production planning.

Production, collection and delivery

Production and delivery times provided by DSP are estimates unless a particular deadline has expressly been agreed in writing.

Timing may be affected by the nature of the job, customer approvals, changes to specifications, material availability, production workload, equipment issues, third-party services or other circumstances reasonably outside DSP's control.

DSP will make reasonable efforts to meet agreed production requirements and will communicate material changes where reasonably practicable.

Collection, delivery or installation arrangements, where applicable to a particular order, will be dealt with in accordance with the accepted quotation or other written arrangement for that job.

Changes and cancellations

If a customer requests changes after artwork, production preparation or manufacturing has started, DSP may need to revise the price and expected completion time.

Cancellation requests should be made in writing as soon as possible. Where DSP has already incurred reasonable artwork, material, production or other costs specifically for the order, the customer may remain responsible for those costs to the extent permitted by applicable law.

Many DSP products are made, printed or personalised specifically for the individual customer's requirements. Custom-made or personalised goods may therefore be subject to different cancellation and return rules from standard off-the-shelf goods.

Returns, defects and claims

Customers are asked to inspect completed work promptly and to notify DSP of any visible issue within 7 days of collection or delivery. Prompt notification allows DSP to investigate the issue while the job and production records are still readily available.

Products correctly manufactured according to customer-approved artwork or specifications cannot ordinarily be returned merely because the customer changes their mind.

If the product is defective, has been produced incorrectly by DSP or does not materially comply with the agreed specification, DSP will assess the matter and provide the remedy required under the applicable agreement and law.

Consumer rights

The request to report issues within seven days does not remove or reduce any right or remedy that a customer may have under the Consumer Protection Act or other applicable law where those rights apply.

Customer-supplied artwork and intellectual property

Customers who provide logos, photographs, artwork, trademarks, fonts, designs or other content to DSP confirm that they have the necessary ownership, licence, consent or permission to use that material for the requested work.

DSP is entitled to rely on that confirmation unless there is a reasonable reason to believe otherwise.

To the extent permitted by law, a customer may be responsible for reasonable losses or claims arising directly from unauthorised customer-supplied material where DSP has used that material in accordance with the customer's instructions.

DSP website and original content

Unless otherwise stated, text, graphics, designs and other original content created for and published on the DSP website may not be copied, reproduced or distributed without the necessary permission.

Limitation of liability

Please read this section carefully

This section limits DSP's liability in certain circumstances. It applies only to the extent permitted by South African law and does not exclude liability or consumer rights that may not lawfully be excluded.

To the extent permitted by law, DSP will not be liable for indirect, special, incidental or consequential losses that were not reasonably foreseeable as a direct result of DSP's breach of its obligations.

Where the law permits a contractual limitation of liability, DSP's aggregate liability arising directly from an affected order will ordinarily be limited to the amount paid for that affected order.

Nothing in these Terms & Conditions excludes or limits liability for gross negligence, fraud, wilful misconduct or any other liability that may not legally be excluded or limited.

Website use and information

DSP takes reasonable care to keep the information on this website useful and accurate. Website content may, however, be updated, changed or corrected from time to time.

Images of completed work are intended to demonstrate examples of print, signage, branding and production capability. Individual project specifications and outcomes will depend on the customer's own requirement and the agreed quotation.

Links to third-party websites or platforms are provided for convenience where relevant. DSP does not control the content, availability or independent practices of those third parties.

Privacy and personal information

DSP processes personal information in accordance with applicable South African data protection law, including the Protection of Personal Information Act 4 of 2013 ("POPIA").

Electronic communications

DSP and its customers may use email, WhatsApp and other electronic communications in the ordinary course of discussing, approving and administering work.

Where an approval or instruction is given electronically and can reasonably be linked to the customer or the customer's authorised representative, DSP may retain that communication as part of the job record.

Customers should notify DSP promptly if an approval or instruction has been sent in error or by someone who was not authorised to act on their behalf.

Relationship between these terms and a quotation

These Terms & Conditions apply together with the accepted quotation, approved artwork and any other project-specific terms agreed in writing.

If a project-specific written term expressly conflicts with a general provision of these Terms & Conditions, the project-specific written term will apply to that job to the extent of the conflict, subject always to applicable law.

Changes to these Terms & Conditions

DSP may update these Terms & Conditions from time to time to reflect changes to its business processes, website or applicable requirements.

Updated terms will be published on this page. The terms applying to a confirmed order will ordinarily be those applicable when that order was accepted, unless a later change is agreed or required by law.

Governing law and disputes

These Terms & Conditions and transactions with DSP are governed by the laws of the Republic of South Africa.

If a concern or dispute arises, customers are encouraged to contact DSP first so that the matter can be reviewed and an appropriate solution considered.

Nothing in these Terms prevents a consumer from exercising any right to approach a competent consumer protection body, court or other forum where that right exists under applicable law.

Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, that provision will be treated as severable to the extent necessary and the remaining provisions will continue to apply.
